Propersend (operated by Depends iT Ltd.) is committed to providing a safe and reliable email marketing marketplace for all our users. We maintain a zero-tolerance stance against spam and require all users of our Service to adhere strictly to this Anti-Spam Policy. This policy is incorporated into and is part of our Terms of Service.

We maintain a zero-tolerance stance against spam and require all users of our Service to adhere strictly to this Anti-Spam Policy. This policy is incorporated into and is part of our Terms of Service.

1. What is Spam?

Spam is defined as any unsolicited commercial email (UCE) or unsolicited bulk email (UBE). This means sending email to anyone who has not given you their direct, express, and verifiable permission to receive communications from you on the topic of the email you are sending.

2. Our Zero Tolerance Policy

We do not permit the sending of unsolicited email through our Service under any circumstances. Any user found to be using Propersend for spamming, or whose sending practices negatively impact the Service’s reputation or deliverability, will face immediate action, including potential suspension or termination of their account and access to the Service, without refund.

3. Permission-Based Marketing is Required

You must only send email to individuals who have given you their clear, unambiguous, and revocable consent to receive email communications from you. This is known as permission-based marketing. Proof of consent must be verifiable and may be requested by Propersend at any time.

Examples of valid consent include:

  • Someone has directly subscribed to your mailing list through a form on your website and confirmed their subscription (double opt-in is highly recommended and required in some jurisdictions).
  • Someone has made a purchase from you and agreed to receive marketing emails from you in the future (implied consent may have specific limitations depending on jurisdiction and relationship duration).
  • Someone has filled out an offline form and explicitly indicated they wish to receive email communications from you

4. Prohibited List Practices

You are strictly prohibited from using the Service to send emails to any list that:

  • Has been purchased, rented, or borrowed from a third party.
  • Has been scraped or harvested from websites or other sources.
  • Consists of email addresses where consent was not specifically obtained by you for the topic of the email being sent.
  • Includes individuals who have previously unsubscribed from your communications.

5. Email Content Requirements

Every email you send through Propersend must comply with the following requirements, in addition to all applicable laws:

  • Accurate Headers: The “From,” “To,” and “Reply-To” fields must be accurate and clearly identify you or your organization.
  • Non-Deceptive Subject Lines: The subject line must accurately reflect the content of the email.
  • Clear Identification: The email must clearly and conspicuously identify that it is an advertisement or commercial message, if required by law.
  • Physical Address: Every email must include a valid physical postal address for the sender.
  • Easy Unsubscribe: Every marketing email must include a clear and conspicuous unsubscribe link that allows recipients to easily opt out of receiving future emails from you. This link must function for at least 30 days after the email is sent.
  • Honor Unsubscribe Requests Promptly: You must honor all unsubscribe requests within 10 business days and immediately update your mailing list to reflect the recipient’s decision.

6. Enforcement and Monitoring

Propersend actively monitors sending activity through our platform to ensure compliance with this Anti-Spam Policy. This includes, but is not limited to, monitoring bounce rates, spam complaint rates, and unsubscribe rates, as well as investigating reports of abuse. We may use automated tools and manual review to identify potential violations.

For users with Hosted Application Instances (Dedicated Server & Fully Self-Hosted), while you have greater control over your instance, you remain fully responsible for all sending activity originating from it. We will investigate complaints and monitor activity from these instances for compliance with this policy.

7. Consequences of Non-Compliance

Violation of this Anti-Spam Policy is a serious breach of our Terms of Service and may result in immediate action, including:

  • Warning
  • Temporary suspension of sending privileges
  • Temporary suspension of account access
  • Permanent termination of account and access to the Service
  • Reporting to anti-spam organizations and law enforcement agencies

No refunds will be provided for accounts terminated due to spamming or violations of this policy.

8. Reporting Spam

If you believe you have received unsolicited email from someone using the Propersend service, please report it to us immediately by forwarding the abusive email, including full headers, to [email protected]. We will investigate all legitimate complaints.

9. Changes to This Anti-Spam Policy

We may update this Anti-Spam Policy from time to time. We will notify you of any changes by posting the new Anti-Spam Policy on this page and updating the “Effective Date” at the top of this policy.
